Welcome to Hanzio. These Terms of Service ("Terms") govern your access to and use of Hanzio's website and mobile application (collectively, the "Services"). By creating an account or using our Services, you agree to be bound by these Terms.

Please read these Terms carefully before using our Services. If you do not agree to these Terms, you may not access or use the Services.

1. Acceptance of Terms

By creating an account, accessing, or using Hanzio, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and Hanzio.

If you are using the Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last updated" date at the top of this page and, where appropriate, notify you via email or through the Services.

Your continued use of the Services after any changes indicates your acceptance of the modified Terms. If you do not agree to the modified Terms, you should discontinue your use of the Services.

3. Description of Services

Hanzio is a Chinese language learning application that provides:

• Dictionary: A comprehensive Chinese-English dictionary with character information, stroke order, and usage examples.
• Spaced Repetition System: An intelligent flashcard system that optimizes your learning by scheduling reviews at optimal intervals.
• Writing Practice: Tools to practice writing Chinese characters with stroke order guidance.
• Progress Tracking: Features to track your learning progress, streaks, and achievements.

We may add, modify, or discontinue features of the Services at any time without prior notice.

4. Your Account

Account Creation

To use certain features of the Services, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain and promptly update your account information.
• Keep your password secure and confidential.
• Notify us immediately of any unauthorized access to your account.

You are responsible for all activities that occur under your account. Hanzio is not liable for any loss or damage arising from your failure to protect your account credentials.

Age Requirements

You must be at least 13 years old to create an account and use the Services. If you are under 13, you may only use the Services with the involvement and consent of a parent or legal guardian. For users in the European Union, the minimum age is 16 unless parental consent is obtained.

By creating an account, you represent that you meet these age requirements or have obtained the necessary parental or guardian consent.

5. Subscriptions and Payments

Free and Premium Plans

Hanzio offers both free and premium subscription plans. Free users have access to core features with certain limitations. Premium subscribers unlock additional features and remove limitations.

Advertising

Free users may see advertisements served by third-party advertising partners (currently Google AdMob). Ads are limited to general-audience content. Premium subscribers enjoy an ad-free experience. For details on how advertising data is collected and used, please see our Privacy Policy.

Subscription Terms

Premium subscriptions are billed on a recurring basis (monthly or annually) according to the plan you select. By subscribing, you authorize us to charge your chosen payment method for the recurring subscription fees.

Automatic Renewal

Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You can manage your subscription and cancel auto-renewal through the Apple App Store or Google Play Store, depending on where you purchased the subscription.

Free Trial

Premium plans may include a free trial period (currently one week) for first-time subscribers. At the end of the free trial, your subscription will automatically convert to a paid subscription at the applicable rate unless you cancel before the trial period ends. You can cancel the free trial at any time through the Apple App Store or Google Play Store.

Price Changes

We may change subscription prices from time to time. Any price changes will apply to subsequent billing periods after notice is provided to you.

6. Refund Policy

Purchases made through the Apple App Store or Google Play Store are subject to the refund policies of those platforms. Please refer to Apple's or Google's refund policies for more information.

By using our app and making in-app purchases, you consent to our sharing of data regarding your usage and consumption of purchased content with Apple, as part of our efforts to resolve refund requests. This information may include details about how you have accessed and interacted with the purchased content. The purpose of sharing this data is to help Apple make an informed decision regarding refund requests.

For purchases made directly through our website (if applicable), you may request a refund within 14 days of purchase if you have not substantially used the premium features. To request a refund, please contact us at support@hanzio.app.

7. Your Use of Services

Permitted Use

You may use the Services only for personal, non-commercial purposes in accordance with these Terms.

Prohibited Conduct

You agree not to:

• Copy, modify, distribute, sell, or lease any part of the Services or included content.
• Reverse engineer, decompile, or attempt to extract the source code of the Services.
• Use automated systems (bots, scrapers, etc.) to access or interact with the Services.
• Interfere with or disrupt the Services or servers connected to the Services.
• Attempt to gain unauthorized access to any portion of the Services or other systems.
• Use the Services to transmit malware, spam, or harmful content.
• Violate any applicable laws or regulations while using the Services.
• Create multiple accounts to circumvent restrictions or bans.
• Share your account credentials with others or allow others to access your account.
• Use the Services, its content, design, features, or user experience as training data for artificial intelligence or machine learning models, or to prompt AI systems to generate substantially similar applications, designs, or content.

8. Community Contributions

Hanzio allows users to contribute content to the community learning pool, including but not limited to mnemonics, proposed meanings, example sentences, votes, and other learning data. When you save a mnemonic, you may choose to share it anonymously with other learners. Sharing is enabled by default but can be turned off for individual mnemonics. Other contributions are shared automatically. By using these features, you agree that:

• Once contributed, community content cannot be individually deleted or withdrawn, as it becomes part of the shared learning resource.
• If you delete your account, your authorship will be anonymized but the contributed content remains available to other users.
• You will not submit content that is offensive, inappropriate, or violates the rights of others.
• Hanzio reserves the right to remove any community contribution that violates these Terms.
• Some contributions (such as usage patterns and preferences) are aggregated anonymously and cannot be attributed to or withdrawn by individual users.

9. Intellectual Property

Our Content

The Services and their entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, audio, and the design, selection, and arrangement thereof) are owned by Hanzio, its licensors, or other providers of such material and are protected by copyright, trademark, and other intellectual property laws.

Your Content

You retain ownership of any content you create within the Services, such as custom decks and community contributions (such as mnemonics, proposed meanings, and example sentences). By creating content, you grant Hanzio a non-exclusive, worldwide, royalty-free license to use, store, and display your content for the purpose of providing the Services to you and, for community contributions, to other users.

Feedback

If you provide feedback, suggestions, or ideas about the Services, you grant Hanzio the right to use such feedback without restriction or compensation to you.

10. Disclaimer of Warranty

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, HANZIO DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted, secure, or error-free, that defects will be corrected, or that the Services are free of viruses or other harmful components.

Hanzio is an educational tool and does not guarantee any specific learning outcomes or results.

Certain features of the Services use artificial intelligence to generate content, such as mnemonics and translations. AI-generated content may contain inaccuracies and should not be relied upon as the sole reference for language learning.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HANZIO AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES.

IN NO EVENT SHALL HANZIO'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES EXCEED THE AMOUNT YOU HAVE PAID TO HANZIO IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED EUROS (EUR 100), WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above limitations may not apply to you.

12. Termination

Termination by You

You may terminate your account at any time by contacting us at support@hanzio.app or through the account settings in the app.

Termination by Us

We may suspend or terminate your access to the Services at any time, with or without cause, and with or without notice, including for violation of these Terms. Upon termination, your right to use the Services will immediately cease.

Effect of Termination

Upon termination, all licenses and rights granted to you will terminate. We may delete your account data in accordance with our Privacy Policy. Provisions of these Terms that by their nature should survive termination will survive.

13. Indemnification

To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Hanzio and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your violation of these Terms, your misuse of the Services, or your community contributions. This clause does not affect your statutory rights as a consumer.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Spain, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the Services shall be resolved through good-faith negotiations. If negotiations fail, disputes shall be submitted to the exclusive jurisdiction of the courts located in Madrid, Spain.

For EU residents, you may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

Nothing in these Terms affects your statutory rights as a consumer under applicable law.

15. General Provisions

Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Hanzio regarding the Services and supersede all prior agreements and understandings.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

Assignment

You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

16. Third-Party Content & Recognitions

Hanzio incorporates content from various third-party sources to provide comprehensive Chinese language learning resources.

Hanzio uses the CC-CEDICT dictionary (CC BY-SA 4.0), data from Wiktionary (CC BY-SA 3.0), MakeMeAHanzi, and example sentences from Tatoeba (CC BY 2.0).

We are grateful to all contributors who have made these resources available. Dictionary data and third-party content are provided for personal, educational use within the Services. Redistribution of third-party content outside the Services may be subject to the original licenses.
